The parents of an 8-year-old boy have filed a lawsuit after alleging their son was targeted by a stadium employee who attempted to sexually assault him inside a bathroom during a Houston Texans game.
The civil lawsuit, filed January 12 in Harris County, Texas, accuses 21-year-old Ushay Marquise Nixon of pulling down the child’s pants and attempting to molest him during the Texans’ December 14 matchup against the Arizona Cardinals at NRG Stadium, according to court records cited by multiple outlets.
Nixon, along with Aramark Sports and Entertainment Services of Texas, LLC and ASM Global Parent Inc., is named as a defendant in the lawsuit.
According to the complaint, the boy was attending his very first NFL game with his family. During the third quarter, his mother escorted him to a men’s restroom and waited outside while he went in alone.
When the child returned, his mother noticed him adjusting his pants. As the family walked back to their seats, a bystander approached and told the parents he had seen their son inside the restroom with an adult employee and that the interaction “didn’t look right,” the lawsuit states.
After being questioned by his parents, the boy said a man had pulled down his pants. His father immediately took him back to the restroom, where the child identified Nixon as the man involved. According to court records, Nixon allegedly ran away and hid inside a storage closet before being located and detained by police.
In a later forensic interview with Houston police, the child said the man directed him into a bathroom stall. Once inside, the stall door was locked, and the man allegedly pulled down the boy’s pants and underwear before lowering his own clothing. The child then fled the stall and ran away, according to court documents.
Surveillance footage reviewed by investigators reportedly shows a man believed to be Nixon — wearing a purple polo shirt — entering and exiting the restroom around the time of the alleged incident.
According to police records cited by local media, Nixon later told investigators he had been assigned to restroom duty that day and claimed he asked the boy if he wanted to see his Pokémon card collection before the child became frightened and ran off.
Harris County court records show Nixon is now charged with felony indecency with a child and felony attempted aggravated sexual assault of a child under the age of 14. He remains in custody at the Harris County Jail while awaiting a court hearing scheduled for February 5. His criminal defense attorney could not be reached for comment.
The emotional toll on the family has been devastating. The boy’s mother told reporters her son has suffered night terrors since the incident and has asked heartbreaking questions like, “Why did God let this happen to me?”
“I feel I failed,” the child’s father said. “I know there was nothing else I could do. I did everything you think is right, but you’re supposed to protect your children, and that day I failed.”
The family’s attorney, Anna Greenberg, said the child went to his first NFL game expecting excitement and joy, “and instead he was targeted by an employee who never should have been allowed anywhere near children.”
The lawsuit alleges Aramark was negligent in hiring Nixon and claims both Aramark and ASM Global failed to provide a safe environment for families at NRG Stadium. Court records also indicate Nixon had been charged in 2022 with indecency with a child and indecent assault, though those charges were later dismissed.
In a statement, Aramark said it is aware of the “very disturbing situation,” confirmed Nixon is no longer employed by the company, and said it is fully cooperating with law enforcement. ASM Global did not immediately respond to requests for comment.
Houston police are asking anyone with information related to the case to contact the department’s Special Victims Unit.
