A Florida man who admitted to abducting a 13-year-old girl after asking her to buy him Burger King before sexually assaulting her has been sentenced to 25 years behind bars.
Bryan Oyanguren Rosado pleaded guilty to kidnapping, sexual battery of a victim younger than 18 and 75 counts of possession of child sexual abuse material, according to the Hillsborough State Attorney’s Office.
Rosado accepted a plea deal that resulted in a 25-year prison sentence, despite Florida sentencing guidelines calling for a minimum term of roughly 330 years.
After completing his prison sentence, Rosado will face another 15 years of sex offender probation and will be required to register as a sexual predator.
Prosecutors said one of the biggest reasons they agreed to the deal was to prevent the teenage victim from having to take the witness stand and relive the terrifying attack in court.
Assistant State Attorney Joseph Kudia acknowledged during the sentencing hearing that prosecutors likely would have pushed for a much harsher sentence if Rosado had refused the plea agreement.
“And quite candidly, in my unit’s review, the number probably should have been higher than this,” Kudia said, according to the Tampa Bay Times.
The disturbing case began on March 2 at the Doral Oaks apartment complex in Temple Terrace, Florida.
According to reports, Rosado approached a group of teenagers and offered one of them $20 to go to a nearby Burger King and buy him food.
A 13-year-old girl agreed and returned with his order.
Authorities said Rosado then grabbed the girl from behind, forced her into his vehicle and drove away.
He allegedly drove the teenager around for several hours before taking her to a neighborhood that was still under construction, where he sexually assaulted her.
At one point during the ordeal, the girl managed to roll down a window and scream for help. Rosado stopped her from escaping and locked the vehicle’s doors and windows, according to reports.
He eventually released the girl near the same apartment complex where she had been abducted.
Investigators later identified Rosado after receiving a tip. Authorities were reportedly able to match his vehicle and cellphone information to the account given by the victim.
The investigation then took an even more disturbing turn.
Authorities searching Rosado’s cellphone reportedly found 20 videos that showed portions of the assault, along with dozens of additional files identified as child sexual abuse material.
Before approving the plea agreement, Hillsborough Circuit Judge Mark Kiser questioned prosecutors about the enormous gap between the roughly 330-year sentence recommended under state guidelines and the 25-year deal.
Prosecutors explained that the victim supported the agreement because it would spare her the mental and emotional trauma of having to testify at trial.
Defense attorney Gabrielle Biggs also pointed to Rosado’s lack of a serious prior criminal history, his apparent remorse and his decision to plead guilty without forcing the victim to participate in a pretrial deposition.
Under Florida law, Rosado must serve at least 85% of his 25-year prison sentence before he can become eligible for release.
